RETURN AND REFUND POLICY
Thank you for shopping on www.pernfurnex.com.my. (also referred to as “the platform”
or Penfurnex) We hope you are happy with your purchase. However, should you face
and/ or refund, within 7 business days from the date of receiving the said item(s), subject
to the terms and conditions in this Return and Refund Policy, as well as Terms of Service.
COMMUNICATION BETWEEN BUYER AND SELLER
Penfurnex encourages Users to communicate with each other in the event where problem
arises in a transaction. As Penfurnex is a platform for Users to conduct trading, Buyer
should contact Seller directly for any issue relating to the Item(S) purchased.
APPLICATION FOR THE RETURN OF AN ITEM
Buyer may only apply for a refund and/ or return of the Item in the following circumstances:
- The Item has not been received by Buyer within the stipulated period as stated by the
- The Item was defective and/or damaged on delivery;
- Seller has delivered an Item that does not match the agreed specification (e.g. wrong
- The Item delivered to Buyer is materially different from the description provided by
- By way of private agreement with Seller. If such is the case, Seller must send his/her
Penfurnex will review each Buyer’s application on a case-by-case basis and, in its sole
discretion, determine whether Buyer’s application is successful. In the event where Buyer
has commenced legal action against Seller, Buyer may provide the formal notification
from the appropriate authority to Penfurnex to request Penfurnex to continue holding the
purchase monies until a formal determination is available. Penfurnex, at its sole and
absolute discretion, will determine whether it is necessary to continue to hold such
purchase monies.
RIGHTS OF SELLER
When Penfurnex receives an application from Buyer for the return of the Item and/or
refund, Penfurnex will notify Seller in writing. Seller may respond to Buyer’s application
according to the steps provided by Penfurnex in the written notification. Seller must
respond within the time-frame stipulated in the written notification (the “Stipulated Period”).
Should Penfurnex not hear from Seller within the Stipulated Period, Penfurnex will
assume that Seller has no response to Buyer’s application and will proceed to assess
Buyer’s application without further notice to Seller. Penfurnex will review each Seller’s
response on a case-by-case basis and, in its sole discretion, determine whether Buyer’s
application may be successful against the circumstances stated by Seller.
CONDITION OF RETURNING ITEM
To enjoy a hassle-free experience when returning the Item, Buyer should ensure that the
Item, including any complimentary items such as accessories that come with the Item,
must be returned to Seller in the condition received by Buyer on delivery. We will
recommend Buyer to take a photo of the Item upon receipt.
Buyer may, by completing the Online Return Form, apply to return the purchased Goods
to Penfurnex or Seller in exchange for a replacement or a refund. Buyer shall ensure that
the purchased Goods is returned to Penfurnex or Seller within 7 or 14 calendar days from
the delivery date, depending on the applicable Return Policy. For avoidance of doubt, the
countdown starts from the date the Buyer received the purchased Goods to the post
stamp date on the return parcel. In case of damaged Goods, please contact Seller within
48 hours of receiving the delivery to expedite the claim process.
LIABILITY OF PRODUCT RETURN SHIPPING FEE
In the scenario of an unforeseen error from the Seller's end (i.e - damaged, faulty or wrong
product delivered to the buyer), the Seller will bear buyer's return shipping fee.
In the scenario where both Seller-Buyer disputing the party liable for the return shipping
fee, Penfurnex at its sole discretion will determine the party liable for the return shipping
fee.
CANCELLATION, RETURN AND REFUND
Buyer may only cancel his/her order prior to completing the payment process.
Penfurnex reserves the right to cancel any transaction on the Site and Buyer agrees that
Buyer’s sole remedy will be to receive a refund via the platform’s payment gateway.
CANCELLATION OF ORDER AFTER PAYMENT
In the event that Buyer decides to cancel his/her order after the relevant order has been
confirmed, paid for, and prior to shipment, Penfurnex shall be entitled to impose a
minimum charge of 15% on the total purchase amount and processing fee, as
administrative fees. In addition, any transaction fees charged by the relevant instalment
payment partner banks will also be imposed. The balance after deduction of the
administrative fees and the transaction fees will be refunded to the Buyer.
APPLICABLE RETURN POLICY WITH CREDIT CARD INSTALLMENT PAYMENT
When the Buyer chooses to make payment for purchase of Goods via Credit Card
Instalments, Penfurnex 7 to 14-days Return Policy will no longer be applicable and the
Buyer will no longer be allowed to return any items unless it is damaged, to which the
item shall be replaced or refunded for the amount paid. Such replacement or refund will
not affect or interrupt the Credit Card Instalments. No returns for “change of mind” reason
will be valid for Buyers that choose to make payment for the Goods via Credit Card
Instalments.
DELIVERY/ PERFORMANCE
Penfurnex has the right at any time to sub-contract all or any of its obligations for the
sale/delivery of the Goods to any other party as it may from time to time decide without
giving notice of the same to the Buyer.
Any dates quoted for delivery of the Goods are approximate only and delays may occur.
The time for delivery/performance shall not be of the essence, and Penfurnex shall not
be liable for any delay in delivery or performance howsoever caused.
If Seller has failed to deliver the Goods in accordance with the Contract or within a
reasonable time, the Buyer shall, by serving a written notice to Penfurnex, be entitled to
demand performance within a specified time thereafter and such specified time shall be
no less than 14 days. If Seller still fails to deliver within the specified time, the Buyer shall
be entitled to terminate the Contract and claim a refund in respect of the undelivered
Goods.
PENFURNEX ASSISTANCE WITH REGARDS TO RETURNS & REFUNDS
Buyer is encouraged to communicate with Seller privately to resolve their differences or
approach the relevant local authorities to assist them in overcoming any dispute prior,
during or after purchase. However, on Buyer’s request (Buyer in this context relates to
purchases/ orders made and transacted via the platform), and on a case- by- case basis,
Penfurnex may extend some assistance to the Buyer in dealing with certain conflicts
which may arise during the course of transaction.
Buyer will only be refunded after Penfurnex has received confirmation from Seller that the
returned Item has been received. In the event where Penfurnex does not hear from Seller
within a specified time, Penfurnex will be at liberty to refund the applicable sum to the
Buyer, without further notice to Seller. The refund will be made to Buyer’s credit/debit card
or designated bank account, whichever is applicable.
