EPenfurnex Mascot Naming Contest

Terms & Conditions

1. By participating the “EPenfurnex Mascot Naming Contest”, the Entrant (“You” or “Entrant”) agree to be fully unconditionally bound
   by these Terms & Conditions, and represent and warrant that You meet the eligibility requirements. In addition, you agree to accept the decisions of Penfurnex are final and binding in all matters related to this Contest.
2. ELIGIBILITY. The Contest is only open to any individuals who are at least eighteen (18) years of age as of the date of entry (the “Entrant”). Entries must not contain any racial, religious or ethnic slurs, explicit language, obscene, pornographic, violent, or sexual content, libel, hate speech, any reference to alcohol, drugs or other illicit substances or otherwise unlawful, inappropriate, objectionable, offensive or illicit content, as determined by Penfurnex. You may be removed from eligibility at the sole discretion of
   Penfurnex.
3. Committees of PFTIA, Employees of PFTIA and Penfurnex are NOT eligible to participate.
4. CONTEST PERIOD. The EPenfurnex Mascot Naming Contest (“Entries”) will be accepted online between 1st November 2021 and 11th November 2021 at 11:59 PM (GMT+8) when the Contest ends.
5. JUDGING CRITERIA. Eligible Entries will be judged by Penfurnex. Entries must not have won a previous prize or award nor been previously published and must be Entrant's original suggestion. In the event of a tie, tied entries will be re-judged by Penfurnex. Penfurnex will aggregate names and choose 1 winner.
6. WINNER NOTIFICATION. The Winner will be notified by Penfurnex via Facebook Messenger direct messaging and electronic mail. The Winner’s name may be posted on Penfurnex's website, social media web pages, email communication or other company materials. If the winner does not reply or respond within 1 week after receiving the Penfurnex notification, the Winner’s entry will be deemed invalid and Penfurnex reserves the right to award the unclaimed Prize to another Entrant in Penfurnex sole and absolute discretion. Any potential winner who fails to comply with the eligibility requirements will be disqualified and another winner may be selected in the place of the disqualified person.
7. The winning name and photo will not be paid any further form of compensation and allows Penfurnex all rights to advertising using print, social media, and/or other methods.
8. PRIZE. This prize & voucher is NOT transferable or exchangeable for cash.
9. RIGHTS GRANTED BY YOU. By entering this Contest, You understand and agree that Penfurnex; anyone authorized to act on behalf of Penfurnex, and Penfurnex licensees, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, and without additional compensation or right of approval, your Entry (e.g., name of the Mascot), your name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent. By entering this Content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Penfurnex. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Penfurnex from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Penfurnex may incur, suffer, or be required to pay to arise out of such infringement or suspected infringement of any third party’s right.
10. Penfurnex reserves the right to withdraw the eligibility of participant if found any breach of Rules & Regulations.
11. Penfurnex reserves the right to make any changes to the above rules & regulations & the prizes without prior notice.
12. GENERAL. Penfurnex reserves the right to cancel the Contest without notice for any reason at its sole discretion. Acceptance of an offered Prize by the Winner constitutes permission to use any of such person’s name, likeness, and biographical information for advertising and publicity, without compensation, unless prohibited by law. Participation in the Contest constitutes an Entrant's full and unconditional agreement to and acceptance of these Terms & Conditions and the decisions of Penfurnex. All entries will be the property of Penfurnex and may be used by Penfurnex in advertising Penfurnex products and services. By entering the Contest, all Entrants assign all of their intellectual property and copyright rights in their Entries to Penfurnex and expressly waive all of their moral rights in favour of Penfurnex. Penfurnex may exploit, edit, modify and distribute the Entry and all elements of such Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party. If for any reason the Contest is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Penfurnex that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Penfurnex reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest.
13. DISCLAIMERS. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL PENFURNEX BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE ACT OF SUBMITTING AN ENTRY, OR INABILITY TO DO
    SO, INCLUDING DUE TO ANY AND ALL TECHNICAL MALFUNCTIONS FOR ANY REASON WHATSOEVER, OR OTHERWISE PARTICIPATING IN ANY ASPECT OF THIS CONTEST OR OUT OF ANY BREACH OF ANY WARRANTY. THE WINNER SHALL BEAR ALL RISK OF LOSS OR DAMAGE TO HIS/HER PRIZE AFTER IT HAS BEEN DELIVERED. PENFURNEX MAKES NO REPRESENTATION OR WARRANTIES OF ANY KIND CONCERNING THE APPEARANCE, SAFETY OR PERFORMANCE OF ANY PRIZE. THIS EXCLUSION OR LIMITATION OF LIABILITY WILL NOT APPLY TO THE EXTENT THAT ANY APPLICABLE STATUTE PROHIBITS SUCH EXCLUSION OR LIMITATION OF LIABILITY.
14. CAUTION. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PENFURNEX RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
